General Terms & Conditions
|
General: All hotel prices listed include room charge and room taxes for
applicable category
on a per person per night based on double occupancy (PPPN). All cruise and tour
prices are
per person double occupancy (PPDO) and include port taxes but not government
fees or
transfers. All prices are subject to availability and may change or be withdrawn
at any time
by the supplier without notice. Not included in the prices are transportation
costs, passport
or visa fees, departure taxes, items of a personal nature, travel and
cancellation insurance,
optional activities, tours, gratuities and taxes unless specifically included.
Bookings and Payment: A full payment is due at the time of booking for
all hotel reserv-
ations made through NonRevResorts.com booking engine. Your credit card will not
be billed
until we have a verified confirmation back from the hotel for your reservation.
Dynamic Travel
& Cruises gladly accepts AMEX, MasterCard, Visa, Discover, cashiers check,
Western
Union Moneygram or cash payment. Cruise and or Tour deposit and final payment
policies
are dictated by the supplier and vary according to itinerary and length of time.
All bookings
are made prior to departure. In the event you elect to pay with cash, please add
an additional
15 days to the deposit and final payment dates that apply to credit card
charges.
Cancellation and Changes: Cancellation or changes to a confirmed
reservation are subject
to availability and to the extent allowed by the hotel, cruise line or other
suppliers’ terms and
conditions and in addition to any charges they may apply will incur a fee of $50
per instance
due to Dynamic Travel & Cruises. Payment of these fees is due at the time the
change is
requested and is owed regardless of whether the requested change can be
accommodated
by the travel provider. In the event that a cancellation or change to a hotel
reservation can be
accommodated and thereby reduces the hotel cost of a confirmed and paid
reservation, no
refunds are available. However a travel credit equal to the amount of the
reduction of service
less any penalties imposed by the travel providers and less any
administrative/change fees
will be issued for use on future travel. This travel credit will be valid for
reservations commenc-
ing travel within 12 months of the original date of travel subject to
availability and may be
applied to any hotel which Dynamic Travel & Cruises makes available as part of
its regular
travel offerings. Credits not used within 12 months will be forfeited. The
credit may not be
used for any bookings made through a GDS system in the manner of a traditional
travel
agency nor may it be applied as payment toward a cruise or tour. Once you have
checked
into your hotel if you depart prior to your original scheduled date, you must
notify us within
7 days of the original checkout date in order to receive a credit for any unused
portion of
your trip. Note that a travel credit is not to be received automatically and is
dependent on
the property making a refund. In the event that they do, the change/cancellation
fees will
be applied prior to any travel credit being issued. Changes or cancellations to
a cruise or
a tour are subject to additional cancellation charges by the cruise line,
airline or tour
operator(s). The supplier cancellation fee schedule may be obtained at the time
of booking.
All cancellations must be confirmed in writing.
Bump Protection (Hotel reservations only): In addition to the terms
listed above, many
hotel properties we offer participate in our bump protection program. This
program provides
that in the event that you are bumped off of your flight and cannot travel to
your destination
on your date of travel you may reschedule (subject to availability) your visit
without the hotel applying a no-show penalty. In order to receive the benefit of
this protection you must adhere
to the following procedure if bumped. If you get bumped during our office hours
(see phone
number below), please notify us immediately and we will re-book for your new
dates. If we
are closed when you are bumped, call the hotel directly and inform them you will
not be
arriving that day. Then call us as early as possible the next day during our
normal business
hours and we will re-book your trip for another date. If you are uncertain of
your new dates,
you have up to one week from the original date of travel to request them before
this benefit
expires. If you do not arrive for your vacation on the date of departure and do
not notify us
of the hotel within 24 hours of your original date of travel, a 100%
cancellation penalty may
apply. Bump protection is specific to the hotel originally booked and is
nontransferable. All
re-bookings are subject to availability at the hotel’s discretion. Additional
charges may apply
if the future dates selected are requested for a period when the hotel has
higher rates in effect.
If any part of your reservation is changed other than the date, change and
cancellation pen-
alties apply. Not every hotel offers this option; in which case normal
change/cancellation rules
will apply. Please ask your booking agent to verify if the property you have
selected offers
bump protection. This option is not available for cruises, tours or reservations
made through
an automated reservation system in the manner of a traditional travel agency.
Non Employee Fee: For some hotels there is a nominal charge for each
non-airline guest
in your party staying in an additional room. Ask your booking agent what that
fee is.
Proof of Citizenship: Proof of US or Canadian citizenship in the form of
a valid passport of
certified birth certificate is required for travel to foreign countries and/or
cruises/tours which
call at foreign ports when sailing from and returning to US ports. A valid
passport is required
when sailing to and disembarking from certain foreign ports. Visas are the
responsibility of
the traveler. Please check with the State Department regarding visa
requirements. Citizens
of countries other than the USA and Canada should check with the consulate(s) of
the
countries to be visited. If only one parent travels with their minor children to
a foreign dest-
ination, they must have a written notarized authorization from the absent parent
to take the
children out of the country. No refunds will be made due to improper
documentation. All
airport departure taxes and transfers to and from the tour vessel are the
responsibility of
the passenger.
Transportation: Dynamic Travel & Cruises/NonRevResorts.com assumes no and
expressly
disclaims any responsibility for the performance or nonperformance of any
transportation
carrier’s obligations or duties to you. Where trips include air transportation,
tickets are issued
by the cooperating carrier on a space available or conditional positive space
basis subject
to review unless otherwise indicated. Dynamic Travel & Cruises/NonRevResorts.com
is not
responsible for any expenses, damages or refunds including ticket refund charges
and or
hotel charges incurred if traveler is denied boarding or is bumped due to any
reason.
Eligibility/Airline Employment: A letter of identification on company
letterhead verifying
your eligibility for a reduced rate benefits from Dynamic Travel & Cruises/NonRevResorts.com
and their suppliers is required prior to the release of any cruise travel
documents. You must
submit a current and original letter of company stationary naming the
employee/retiree and
his or her eligible family members. This letter should be signed by a supervisor
or personnel
department of employee travel office. (A retiree need not have a current dated
letter, however
must provide a copy of his or her retiree badge.) Failure to submit a current
airline letter of
eligibility within 24 hours of final payment will result in the loss of the
Dynamic Travel &
Cruises rate. Proof of eligibility must also be available for inspection upon
check-in of all hotel
reservations. In addition, most cruise lines and tour operators also require a
copy of your
airline ID badge to be submitted at the same time as the letter of employment.
Travel Insurance: We recommend the purchase of travel and missed trip
insurance to
protect your trip investment.
Itinerary/Supplier Alterations: All tours and cruises are offered on the
basis of existing air,
tour and cruise schedules and are subject to change. The cruise lines and tour
companies
reserve the right to change the itinerary without prior notice. In the event of
a reduction of
services provided or changed to a hotel at a lower rate then the type included
in the tour a
proportionate refund will be made at the discretion of the tour operator(s) or
cruise line. In the
event the hotel is oversold upon your arrival the hotel reserves the right to
accommodate you
at an equivalent or better property with no further liability.
Express Notice of Agency: Dynamic Travel & Cruises/NonRevResorts.com is
headquartered
in Southlake, Texas and acts only as a third party booking agent for suppliers
providing cruise,
tours, hotels and other services. We do not control the service providers, on
whose behalf we
market, or the activities engaged by our clients, and therefore cannot be
responsible for their
acts or omissions, responsibility for which is expressly disclaimed. Dynamic
Travel & Cruises
is not responsible for and expressly disclaims responsibility for any claims,
losses, damages,
costs of expenses arising out of acts, errors, omissions, personal injury,
sickness, accident
or death, damage, theft, loss or delay of baggage or other property, or delay of
inconvenience,
loss of employment, loss of pay, upset, disappointment, distress, frustration
whether physical
or mental resulting from, but not limited to: 1) The act of omission of any
person or persons at
hotels, cruise lines, tour operators, airlines, transfer companies, other
service providers, and
clients, and 2) Mechanical breakdowns or malfunctions, government actions,
strikes, lockouts,
ware, terrorism, weather, act of God, or other factors and causes beyond our
control. Your
payment for, or embarkation, departure on a cruise or tour constitutes your
consent to the
Terms and Conditions herein. All services and goods are accepted on a
non-warranty “as-is”
basis. No express warranties are given by Dynamic Travel &
Cruises/NonRevResorts.com.
All implied warranties are expressly disclaimed. Texas substantive law is
controlling. This
Agreement shall be at least partially performed in Tarrant County, Texas. Venue
and
jurisdiction for any disputes arising from this Agreement shall be in Tarrant
County, Texas,
and in your case solely there.
Miscellaneous: A) All prices are subject to change or cancellation
without notice. B) Certain
hotels allow airline employees’ immediate family members to travel without the
employee,
i.e. spouse, children and parents. In this event the traveling party must
present copy of
employee’s ID badge at check-in. C) Dynamic Travel & Cruises/NonRevResorts.com
is not
responsible for typographical errors. D) These General Terms & Conditions are
subject to
change without notice and other restrictions may apply.
